Nebraska Posting Laws: How to Post Land

In Nebraska, the posting rules with real numbers belong to hunting signs. Statute 37-724 describes 'Hunting By Written Permission Only' signs and red paint marks. General trespass under 28-521 is looser, so those hunting-sign details are a handy pattern for any notice.

What the sign must say and show

For hunting-permission signs, 37-724(1) asks for letters at least one and one-half inches high on a sign at least 11 by 14 inches. Each sign carries the name and address of the owner or tenant. That name rule applies only to those hunting signs. General trespass under 28-521 has no name rule, so check which kind of notice you want.

Spacing and placement

Hunting signs go at each field entrance, at all property corners, and at intervals of not more than 440 yards. That is a tight grid for a big farm, so count your entrances and corners before you order a batch.

The general trespass notice in 28-521 is not defined with sizes or spacing in the statute text we read. Where the law is silent, place signs where a visitor would naturally walk or drive in.

Red paint, not purple

Nebraska has no purple paint rule. Section 37-724(2) allows red paint, but only for hunting by written permission. The marks are vertical lines at least 8 in long and 3 in wide on trees or non-metal posts. On metal posts, the mark wraps around the post and extends at least 8 in down from the top. The bottom edge sits 3 to 5 ft above ground. Marks go at each field entrance, not more than 100 yards apart, and must be readily visible.

Hunting and landowner permission

Section 37-722 makes it unlawful to take wildlife on any private land without the owner's permission, whether or not the land is posted. Game and Parks says permission is needed on all private land not in public access programs. Posting is a clear reminder, but it is not what creates the permission rule.

Questions about posting land in Nebraska

How big must a Nebraska hunting-permission sign be?

Under 37-724(1), a 'Hunting By Written Permission Only' sign must be at least 11 by 14 inches, with letters at least one and one-half inches high. Each sign shows the name and address of the owner or tenant. Read the current statute before you print.

Can I use paint instead of signs in Nebraska?

For hunting by written permission only, 37-724(2) allows red paint, not purple. Use vertical lines at least 8 in long and 3 in wide, with the bottom edge 3 to 5 ft above ground, at each field entrance and not more than 100 yards apart.

Do hunters need permission on unposted private land in Nebraska?

Yes. Section 37-722 makes it unlawful to take wildlife on any private land without the owner's permission, whether or not it is posted. Game and Parks also says permission is needed on all private land not in public access programs.
